In 2014, new federal rules were released by the Centers for Medicare & Medicaid Services (CMS), requiring residential facility homes and programs where Home and Community-Based Services (HCBS) are provided to meet new criteria. The Department of Developmental Services (DDS), regional centers, and vendored service providers are working to implement the requirements for home and community-based settings in accordance with this Final Rule. On July 14, 2020, CMS issued guidance indicating that the transition period for ensuring compliance with the HCBS Final Rule has been extended to March 17, 2023. Pursuant to Welfare and Institutions Code section 4519.2(b), each regional center shall post information regarding HCBS Final Rule compliance on its website. This information is to be updated no less frequently than every six months until DDS has determined that statewide compliance with the HCBS Final Rule has been met, or January 1, 2025, whichever is earlier.
